Hatchitt disclaims all warranties, express or implied, including warranties as to accuracy, merchantability, fitness for a particular purpose, non-infringement, and all warranties arising from course of dealing, usage, or trade practice.

Hatchitt disclaims any liability or responsibility for acts, omissions, or conduct of the user.

Hatchitt shall not be liable for any direct, indirect, consequential, incidental, special, punitive, or other losses, including lost profits, revenues, data, goodwill, or similar damages arising from or related to the Website and/or its services.

In no event shall Hatchitt’s liability exceed $100.

Some jurisdictions restrict or alter these disclaimers and limitations; therefore, some restrictions may not apply.

Choice of Law and Forum

These TOS shall be governed by the laws of the United States and the State of Wyoming, without regard to its conflict of law provisions.

You agree that any cause of action that may arise under these TOS shall be commenced and heard in the appropriate court in the State of Wyoming, County of Sheridan.

You further agree to submit to the personal and exclusive jurisdiction of the courts located in Sheridan County, Wyoming.

You agree to waive all respective rights to trial by jury.

Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Website and/or its services must be filed within two years of the date on which it arose or the time in which it could have been reasonably discovered, or it shall be forever barred.
